Access to and use of Predictive CyberLab (programme and organisation workspace), published by OPEN C FUTURE.
1. Publisher
The Predictive CyberLab platform is published by OPEN C FUTURE, a simplified joint-stock company (SAS), 80 rue d’Assas, 75006 Paris, registered with the Paris Trade and Companies Register under number 953 641 628.
2. Purpose
These terms govern access to the professional SaaS service: the learning path (film, Briefings, exam, certificate), administration (licences, brand, invitations, statistics) and payment. Use of the organisation workspace constitutes acceptance of these terms.
3. Account and licences
Access is limited to professionals. The Client appoints an organisation administrator. The number of purchased seats limits enrolments. Credentials are personal and confidential. Account sharing is forbidden.
4. Order, price and payment
Catalogue prices are exclusive of tax. French VAT at 20% applies to an organisation established in France. Reverse charge applies if the Client is established in the EU outside France and holds a valid intra-community VAT number. Out of scope if the Client is established outside the EU. Card payment is processed by Stripe (PCI DSS); Predictive CyberLab does not store card data. An invitation code or voucher may open the workspace without an immediate charge. The invoice is issued in the name of the organisation.
5. Content and intellectual property
Films, Briefings, questionnaires, templates and interfaces are the exclusive property of OPEN C FUTURE. The Client receives a non-exclusive, non-transferable licence limited to the contract and the purchased seats. Extraction, reverse engineering, public redistribution and any use outside the contract are forbidden.
6. Client obligations
The Client warrants the accuracy of the staff file (email, identity; role and seniority optional), has a legal basis to invite employees and third parties, respects licence quotas and does not use the service other than for awareness and governance of its organisation and contractual network.
7. Availability
OPEN C FUTURE uses reasonable efforts to keep the service available, under a best-efforts obligation. Maintenance or update interruptions may occur without automatic compensation.
8. Liability
Predictive CyberLab is an awareness and governance tool. A certificate or a high score does not guarantee the absence of an incident. OPEN C FUTURE is not liable for indirect damage (loss of business, data loss, ransom).
9. Personal data
Processing is described in the privacy policy. The Client is controller of the people it invites. The checkbox at checkout is acceptance of these terms and of that policy on behalf of the organisation.
10. Term and termination
The service runs for the term of the subscription, voucher or invitation. Termination for material breach after an unsuccessful formal notice. Access ends at expiry. Invoices are retained to meet accounting duties.
11. Governing law
These terms are governed by French law. Any dispute between professionals falls under the exclusive jurisdiction of the Paris Commercial Court.
